1. Acceptance of Terms

By accessing and using ASM AI trading services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

ASM AI provides algorithmic trading services including:

• Automated trading algorithms powered by artificial intelligence
• Real-time market analysis and trading signals
• Risk management and portfolio optimization
• Trading strategy development and backtesting
• Market data analysis and reporting

3. Eligibility and Requirements

To use our services, you must:

• Be at least 18 years old
• Have legal capacity to enter into binding agreements
• Comply with all applicable laws and regulations
• Provide accurate and complete information
• Meet minimum investment requirements

Restricted Users:

• Residents of jurisdictions where our services are prohibited
• Individuals on sanctions lists
• Users who have been previously suspended or banned

4. Risk Disclosure

• You may lose some or all of your invested capital
• Past performance does not guarantee future results
• Market conditions can change rapidly
• Algorithmic trading involves technical risks
• You should only invest money you can afford to lose

5. Fees and Payments

Fee Structure:

• Management Fee: 2% annually on assets under management
• Performance Fee: 20% of profits above high water mark
• Setup Fee: One-time charge for account activation
• Transaction Fees: As disclosed in fee schedule

Payment Terms:

• Fees are automatically deducted from your account
• Management fees are charged monthly
• Performance fees are charged quarterly
• All fees are non-refundable

6. Intellectual Property

All content, software, algorithms, and materials provided by ASM AI are protected by intellectual property laws:

• Trading algorithms and AI models are proprietary
• Software and platforms are licensed, not sold
• You may not reverse engineer or copy our systems
• All trademarks and logos are our property

7. Limitation of Liability

To the maximum extent permitted by law, ASM AI shall not be liable for:

• Any trading losses or investment losses
• System downtime or technical failures
• Third-party actions or market conditions
• Consequential or indirect damages
• Force majeure events

8. Termination

You may terminate:

• At any time with 30 days written notice
• Subject to completion of open positions
• After payment of all outstanding fees

We may terminate:

• For breach of these terms
• For suspected fraudulent activity
• If required by law or regulation
• With 30 days notice for any reason

9. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Austria. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts in Vienna, Austria.
